4月14日, 2003, regulations that are part of the 健康保险可携性 and 责任法案(HIPAA) went into effect. These regulations (Privacy Rule) govern how health care providers and health plans can use or disclosure personally identifiable health information on their patients, 包括研究目的.

These regulations may impact 研究ers if:

  • Their current 研究 studies involve the use of personally identifiable health information maintained by a hospital, 诊所, 医生, 专业协会, or other HIPAA-covered health care provider, 或者是私人的, 状态, 或联邦健康保险计划(e.g.比如医疗补助)，或者
  • They plan to conduct a study involving the use of personally identifiable health information obtained from the entities mentioned in the above bullet.

As 研究 involving personally identifiable health information qualifies as human subjects 研究, such 研究 conducted by UNH agents must be reviewed and approved by the UNH Institutional Review Board for the Protection of 人类被试 in 研究 (IRB) prior to commencing.

除了, UNH 研究ers who plan to obtain personally identifiable health information from HIPAA-covered health care entities should check with those covered health care entities as early as possible to find out any requirements for review by their own IRBs. UNH 研究ers are strongly encouraged to contact the Privacy Officer in the covered health care entity to obtain the most accurate information on the entity’s specific HIPAA requirements.
